Principles of Natural Justice–A Refresher for Adjudicators

Synopsis

Under Section 16(5)(c) of the Building and Construction Industry Security of Payment Act 2004, adjudicators are required to uphold the principles of natural justice. The Code of Conduct for Adjudicators reinforces this duty, and any breach may constitute misconduct under the Disciplinary Rules, potentially leading to an invalid adjudication determination.

A failure to uphold natural justice not only impacts individual cases but also undermines public confidence in the adjudication system.
